01The agreement, and who we are
híbrido is operated by Everseed Ventures, based in Calgary, Alberta, Canada ("we", "us"). These terms apply to the híbrido app for iPhone and Apple Watch and to this website. By creating an account, using the app or using the site, you accept these terms, our Health and safety page and our Privacy policy. If you do not accept them, do not use híbrido.
02What híbrido is
One 50-minute heart-rate class each day, the same for everyone, with a machine half and a floor half that adapt to the equipment you choose. Classes are written by our system from a fixed catalog of exercises and coached by characters whose images and voices are generated by computer.
A community where members post how a class felt and like and comment on each other's posts.
híbrido is general fitness guidance. It is not medical advice, not personal training, and not a treatment for any condition. Read the Health and safety page before your first class.
03Who can use it
You must be at least 18 years old and able to form a binding contract. híbrido is offered first in the United States and Canada.
You confirm that you have no medical reason not to exercise, or that a doctor has cleared you to do the kind of exercise híbrido offers.
04Training is at your own risk
You train unsupervised, and nobody at híbrido can see you. We do not know your medical history, injuries, medications or fitness, and nothing in the app is adjusted for them.
You voluntarily assume all risks of injury, illness or death that may result from using híbrido, including from doing a class, using exercise equipment, training outdoors, or acting on heart-rate readings that are inaccurate. You are solely responsible for deciding whether a class is appropriate for you and for how you do it.
To the fullest extent permitted by law, you release us from claims arising from those risks, except where the law does not allow such a release.
05Your account
You sign in with your email address and a 6-digit code we send to it, or with Sign in with Apple. Keep access to that email secure: anyone who can read it can sign in as you. Tell us at once if you think someone else has used your account.
You choose a public handle and an avatar or photo. Your handle must not impersonate anyone, including híbrido, our coaches or another member.
You can delete your account at any time from the app. Deleting it removes your profile, your class history, your posts and their photos, your comments and your likes, as described in the Privacy policy.
06Community rules
The class is meant to feel like a room full of people cheering each other on. In posts, comments, handles and photos, you must not:
- harass, threaten, bully, shame or demean anyone, including about their body, weight, ability or appearance
- post hate speech, or content attacking people for race, ethnicity, religion, gender, sexual orientation, disability, age or any similar characteristic
- post nudity, sexual content, graphic violence or self-harm content
- give other members medical advice, or promote extreme dieting, disordered eating, unsafe supplements, drugs or training through injury
- post photos of other people without their permission, or any photo of a child
- share someone's personal information, advertise, spam, or link to scams
- post anything that is illegal or that infringes someone else's rights
07Your posts and photos
You keep ownership of what you post. You give us a worldwide, non-exclusive, royalty-free licence to host, store, display and resize it so that it can be shown to other members in híbrido, for as long as it stays posted. When you delete a post or your account, the licence ends, apart from copies in backups that expire on their normal schedule.
You confirm you have the right to post what you post, including any photo.
If you believe something posted in híbrido infringes your copyright, write to team@everseedventures.com with the work you own, where it appears in híbrido, your contact details, and a statement that you have a good-faith belief the use is not authorised and that your notice is accurate. We will remove infringing content and close the accounts of repeat infringers.
08Reports, blocks and removal
Every post and comment can be reported, and any member can be blocked. Reported content disappears from your screen straight away; to stop seeing a member's posts for good, block them. We review reports and remove content that breaks these rules, and we aim to act on every report within 24 hours.
We may remove any content, and suspend or close any account, that breaks these terms or puts other members at risk, with or without notice.
09Price
híbrido is free during early access. If we introduce a paid plan, we will tell you the price and what it includes before you are charged anything, and paying will be your choice.
10Apple
These terms are between you and us, not Apple. Apple is not responsible for híbrido or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Your licence to use the app is limited to Apple devices that you own or control, as the App Store's Usage Rules allow. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligation for the app. Apple is not responsible for investigating, defending or settling any claim that the app or your use of it infringes someone's intellectual property.
You confirm that you are not located in a country subject to a U.S. Government embargo, and are not on any U.S. Government list of prohibited or restricted parties.
11What belongs to us
The classes, the exercise catalog, the coaches, their images and voices, the app, this site, the design and the híbrido name and ember mark belong to us or our licensors. You may use them to train. You may not copy, republish, resell, scrape or build a competing product from them.
12Availability and changes to híbrido
We intend to publish a class every day, but we do not promise that híbrido will always be available, uninterrupted, complete or error-free. We may change, pause or stop any part of it.
13Disclaimer of warranties
híbrido is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that any heart-rate reading, zone, estimate or goal is accurate or suitable for you.
14Limitation of liability
To the fullest extent the law allows, Everseed Ventures and its directors, employees and contractors are not liable for any indirect, incidental, special, consequential or punitive damages, or for any personal injury, illness or death, arising out of your use of híbrido. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim, or CAD $100.
Nothing in these terms limits liability that cannot lawfully be limited, including for fraud or, where the law forbids it, for death or personal injury caused by our negligence. If you are a consumer, you keep the protections the mandatory law of your province or state gives you.
15Your responsibility to us
If you break these terms or the law, or post something that infringes someone's rights, and a claim is made against us because of it, you agree to cover our reasonable losses and costs from that claim.
16Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. The courts of Calgary, Alberta have jurisdiction over any dispute, unless the law of the place you live gives you the right to bring it there.
17Changes to these terms
If we change these terms we will update the date at the top. If a change is significant, we will tell you in the app before it applies. Using híbrido after a change takes effect means you accept it.
